Jennifer Hudson and David Otunga have settled on a custody arrangement for their son, at least for now.

The pro wrestler has been granted primary custody of 8-year-old David Jr., according to TMZ. The courts believe Hudson’s busy schedule — she’s currently in London for The Voice U.K —means Otunga will be a more present parent for the time being. Reportedly, the former reality star has been his son’s primary caregiver for years due to the Oscar winner’s travel schedule.

Hudson has also dropped her protective order, which prohibited David from having contact with her or their son.

Another love bites the dust! Recently it was reported that singer-actress Jennifer Hudson and her longtime partner, David Otunga, have decided to call it quits.

Although details surrounding the split have yet to emerge, it has been confirmed that the  singer, 36, has been granted a protective order from the 37-year-old wrestler. In a statement released exclusively to PEOPLE, the couple, who share a son (8-year-old David Jr.), have been in the process of breaking up for a while.

“They [Hudson and Otunga] have been in the process of ending their relationship for a number of months… Today, Jennifer requested and received a protective order against her ex-fiancé. Jennifer’s actions are solely taken in the best interest of their son.”

Fans of Hudson have been questioning her pending marital status for years due to her and Otunga’s nine-year engagement status. However, the couple’s split still comes as a shock, as Hudson gave TV host Ellen DeGeneres a positive relationship update back in April of this year. When the singer was asked about Otunga, she  confidently replied “I’m not in a rush [to marry]. He ain’t going no where.”
