An Austin, Texas, man is suing a woman he went on a date with for texting while at the movie theater.

In a petition filed in a Travis County small claims court, 37-year-old Brandon Vezmar is asking his date to pay $17.31, which was the price he paid for a 3D movie ticket for Guardians of the Galaxy, Vol. 2., The American-Stateman reports.

“It was kind of a first date from hell,” Vezmar said. “[Texting] is like one of my biggest pet peeves.”

Vezmar said his date started texting about 15 minutes into the film. He asked her to stop, but said she refused. Vezmar then suggested that maybe she should go outside of the theater and text. She obliged, but never returned. She also left Vezmar without a ride, as they drove to the theater in her vehicle.

The woman also spoke with The American-Stateman. She told the paper that she only texted two or three times in the theater, and that she was texting a friend who was having an altercation with her boyfriend.

I had my phone low and I wasn’t bothering anybody,” she said. “It wasn’t like constant texting.”

She also told the paper that she’d refused Vezmar’s request for her to pay for her movie ticket because “he took me out on a date.”

The woman plans to file a protective order against him for contacting her sister in hopes of getting money for the ticket.

The petition states that the texting was a “direct violation” of the theater’s policy and that Vezmar’s date “adversely” affected his viewing experience of the film and that of other patrons.

“While damages sought are modest, the principle is important as defendant’s behavior is a threat to civilized society,” the petition said.

“I’m not a bad woman,” the woman said. “I just went out on a date.”
