A federal appeals court will examine a defamation lawsuit filed against famed actor and comedian Bill Cosby, Page Six reports.

At the request of Katherine McKee, Boston’s 1st U.S. Circuit Court Court of Appeals will reinstate her lawsuit against The Cosby Show star, which was dismissed by a federal just in Massachusetts in February.

The former actress is accusing Cosby of defaming her in a letter sent by his lawyer to the New York Daily News. The document demanded a retraction of a 2014 story that referenced McKee’s rape allegations against the comedian.

According to lawyers representing McKee, the letter was a  “purposeful attack” on her character and reputation. They also claimed it was created with “ill will, malevolence and evil intent.”

The judge who originally dismissed the lawsuit concluded that Cosby’s letter was protected by the First Amendment.

More than 50 women have accused Cosby of drugging and sexually assaulting them over the course of three decades.

Cosby has repeatedly denied the allegations.
