Being Black can get you legally evicted from your home, the New York Daily News reports.

A Wisconsin Court of Appeals ruled that Michael Haller, who is White, had the right to force his tenant, Martin Jones, from his home because he is African-American.

Jones was put out of Haller’s house in the Bay View area of Milwaukee, WI, in 2013, after Haller’s wife expressed discomfort with having an African-American living in their home.

While Wisconsin law prevents landlords from discriminating against tenants because of race, the court ruled that because Jones was living in Haller’s house and not a separate unit or building, the anti-discrimination law did not apply.

The court said that as a homeowner, Haller has the right to decide who shares his home.

Jones’ attorney has not released a formal statement in response to the ruling.
