The Hill reports that the Trump administration will be overturning a previous policy that excused pregnant women from immigration detention.

Based on internal documents reviewed by the publication, Immigration and Customs Enforcement (ICE) officers will treat pregnant women they detain the same as all others. The only stipulation is all pregnant women in custody must be logged and given the necessary prenatal medical care.

A previous policy set up by ICE Director Thomas Homan stated: “absent extraordinary circumstances or the requirement of mandatory detention, pregnant women will generally not be detained by ICE.” The new policy was outlined in “Identification and Monitoring of Pregnant Detainees” a directive Homan sent in December 2017.

The new policy is explained in an internal email obtained by The Hill. Based on the email ICE will process pregnant women on a “case-by-case custody determination taking any special factors into account.” Women in their third trimester of pregnancy will not be detained under the new policy. The message asserts detaining pregnant women will “better align with the President’s Executive Order.”

President Donald Trump signed an executive order in January to enforce stricter immigration operations.

Under the Trump administration, ICE has fallen under heavy criticism for the separation of families, the deportation of members of the military, and alleged discrimination.
