Just over a week after Empire co-creator Lee Daniels attempted to move actor Sean Penn’s $10 million defamation lawsuit against him to federal court, Daniels seems to have retracted his move and paid the star out.

A letter from Daniels’ lawyer was released on Wednesday. It said that Daniels will “withdraw his Notice of Removal, and have this matter remanded to the Supreme Court of the State of New York.”

The letter, filed in federal court, goes on the add that “further, the parties’ resolution includes Daniels’ payment of a confidential monetary amount to Penn consistent with the guiding principles” of the U.S. code.

No specific dollar amount was disclosed, but reports say payment to Penn was for his legal fees.
