Attorneys representing the Minnesota cop who fatally shot Philando Castile filed a motion Wednesday for charges against their client to be dropped, Twin Cities Pioneer Press reports.

Castile was killed on July 6 after police pulled him over for a broken taillight. Officer Jeronimo Yanez is facing a manslaughter charge for shooting Castile, whose death was recorded via Facebook Live by his girlfriend.

The traffic stop took place in Falcon Heights, which contracts with St. Anthony for police services.

When filing the charge against Yanez on Nov. 16, Ramsey County Attorney John Choi said “no reasonable officer knowing, seeing or hearing what officer Yanez did would have used deadly force.”

But in documents filed Wednesday to support the motion to dismiss all charges, defense attorneys argued that Castile, 32, was high on marijuana. An autopsy conducted on Castile indicated he had high levels of THC, the primary chemical found in weed.

In the documents, attorneys argue Castile ignored Yanez’ commands and stared straight ahead during the traffic stop. They say he was negligent in the incident.

Attorney Glenda Hatchett is representing Castile’s family. In a statement, she said, “The charges filed by Prosecutor Choi speak for themselves and there will be no further comment.”

Castile’s fiancée, Diamond Reynolds, was in the car with her 4-year-old daughter at the time of incident. Her Facebook Live video sparked protests about police shootings nationwide.
